The right to silence?

Does this mean that if they want, the accused doesn't have to say anything?|||The Fifth Amendment is only a small part of your right to remain silent. It only applies to self incrimination, you can not plea the Fifth if you are questioned about anything that will not incriminate you.





You are never under any obligation to speak to an officer. Only a judge or Grand Jury can compel you to speak.





The US court system is based on presumed innocence. This means you are innocent until proven guilty. Remaining silent does not affect this presumption, the prosecution is still required to prove your guilt. You are under no obligation to prove your innocence.|||5th amendment states that no person shall be forced to present themselves as a witness against themselves if they so choose.





so yes, you have the right to not say a damn thing.|||Yes, its called pleading the 5th or 5th amendment. It means you have the right NOT to incriminate yourself.|||Yep, and you don't even have to put up a defense.
